Our Privacy Policy, Terms of Service and Cookie Policy are published here in full. These website policies are separate from the agreements that govern the lumaq platform and delivery services.

Privacy Policy

This Privacy Policy explains how Lumaq Inc. (“lumaq”, “we”, “us”, “our”) collects, uses, shares and protects personal data in connection with our website at lmq.tmoblabs.com and lumaq.ai (the “Site”). We are the controller of the personal data described here. Personal data processed on behalf of our enterprise customers inside the lumaq platform during a delivery is processed under the applicable master agreement and Data Processing Agreement, and is not covered by this policy.

2. Definitions

  • Data subject — the individual the personal data relates to; on the Site, usually you.
  • Personal data — any information relating to an identified or identifiable person.
  • Controller — the party that determines the purposes and means of processing (here, lumaq).
  • Processor — a party that processes personal data on a controller’s behalf.
  • Processing — any operation performed on personal data (collection, use, storage, disclosure, deletion).
  • GDPR — Regulation (EU) 2016/679, and equivalent data-protection law where applicable.

3. Scope

This policy applies to personal data about visitors to the Site, people who contact us or request a call, and candidates who apply through our careers pages. It does not apply to the software, source code or customer data processed within the lumaq platform, which is governed by the customer’s agreement and Data Processing Agreement.

4. What we collect, why, and how long

We collect the following personal data, for the purposes and on the legal bases set out below.

5. How your enquiry and application materials are handled

Messages, the project details you share when you request a scoping call, and job-application materials are accessible only to the people who need them to respond to you or assess your application. We do not use them for any unrelated purpose, and we do not sell them.

6. Your data and our models

Personal data you submit through the Site is never used to train AI models. Within the lumaq platform, customer data stays in the customer’s environment, is processed on the customer’s instructions, and is never used to train models — as set out in the customer’s agreement and DPA.

7. Service providers and recipients

We share personal data only where necessary, with the following categories of recipients. We do not sell personal data.

  • Infrastructure and hosting providers that operate our Site and systems.
  • Analytics and communications providers that support the Site.
  • Professional advisors (legal, accounting) and authorities where required by law.
  • A prospective buyer or successor entity in a corporate transaction.

8. International transfers

Where personal data is transferred outside your jurisdiction or the EEA, we rely on an adequacy decision or appropriate safeguards, including the EU Standard Contractual Clauses, together with supplementary measures where required. A copy of the relevant safeguard is available on request at company@lumaq.ai.

9. Security

We apply appropriate technical and organisational measures, including access controls, encryption in transit and at rest, least-privilege access, logging and monitoring. No method of transmission or storage is completely secure, but we work to protect your data and to notify you and the authorities where required by law.

10. Automated decision-making

We do not make decisions that produce legal effects concerning you, or similarly significantly affect you, based solely on automated processing of your personal data through the Site.

11. Children

The Site is not directed to children, and we do not knowingly collect personal data from anyone under the age of 16.

12. Your rights

Subject to applicable law, you have the following rights. To exercise any of them, contact company@lumaq.ai. You also have the right to lodge a complaint with your local data protection supervisory authority.

  • Access — obtain a copy of your personal data.
  • Rectification — have inaccurate or incomplete data corrected.
  • Erasure — have your data deleted where applicable.
  • Restriction — limit how we process your data in certain cases.
  • Objection — object to processing based on legitimate interests or for direct marketing.
  • Portability — receive certain data in a portable format.
  • Withdraw consent — at any time, without affecting prior processing.

We may update this policy from time to time. The effective date above reflects the current version, and we will indicate material changes on this page.

Terms of Service

These Terms govern your access to and use of the lumaq website at lmq.tmoblabs.com and lumaq.ai (the “Site”), operated by Lumaq Inc. (“lumaq”, “we”, “us”). By accessing or using the Site you agree to these Terms. Access to and use of the lumaq platform and any delivery services is governed by a separate written agreement, not by these Terms.

1. Acceptance

If you do not agree to these Terms, do not use the Site. If you use the Site on behalf of an organisation, you confirm you are authorised to accept these Terms for it.

2. Intellectual property and trademarks

The Site and its content — including text, design, graphics, code, and the lumaq name, logo and marks — are owned by lumaq or its licensors and protected by intellectual property laws. The lumaq name and logo are our trademarks and may not be used without our prior written consent. Except as expressly permitted, you may not copy, modify, distribute, publicly display or create derivative works from the Site.

3. Acceptable use

You may use the Site for lawful, informational and business purposes only. You must not:

  • Break any applicable law, or infringe the intellectual property, privacy or other rights of any person.
  • Upload or transmit malware, or attempt to gain unauthorised access to any system, account or data.
  • Interfere with, disrupt, overload or probe the security of the Site or its infrastructure.
  • Scrape, harvest or collect data other than as expressly permitted, or circumvent access controls.
  • Misrepresent your identity or affiliation, or use the Site to deceive or harm others.

4. Enquiries and submissions

If you submit information through the Site (for example an enquiry or a job application), you confirm it is accurate and that you are entitled to provide it. You are responsible for the content you submit. Good-faith security reports are welcome at company@lumaq.ai; please allow us a reasonable time to remediate before any disclosure.

5. Third-party links

The Site may link to third-party websites or resources. We are not responsible for their content, policies or practices, and links do not imply endorsement.

6. No warranty and availability

The Site is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, or that the Site will be uninterrupted, secure or error-free. We may change, suspend or withdraw all or part of the Site at any time without notice, to the fullest extent permitted by law.

7. Limitation of liability and risk

To the fullest extent permitted by law, lumaq will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising from or related to your use of the Site. Your use of the Site is at your own risk. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

8. Indemnity

You agree to indemnify and hold lumaq harmless from claims, damages, liabilities and expenses arising out of your misuse of the Site or breach of these Terms.

9. Privacy

Your use of the Site is also subject to our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.

10. Changes and severability

We may update these Terms from time to time; changes take effect when posted on this page, and continued use constitutes acceptance. If any provision is held unenforceable, the remaining provisions stay in full force and effect.

11. Governing law and jurisdiction

These Terms are governed by the laws of the State of Delaware, USA, and the state and federal courts located in the State of Delaware have exclusive jurisdiction over any dispute, without prejudice to any mandatory protections available to you under local law.
